RENTAL AGREEMENT
When you submit this form, you’re agreeing to the following:
1. GENERAL: You (the “Tenant”) agree to rent from us (the “Landlord”), and the Landlord agrees to lease to the Tenant the property. We both agree that the Property is a vacation rental, and that you are a transient guest or seasonal Tenant. The Tenant may be removed from the property and evicted at the end of the lease term.
You must be 25 years or older, be responsible for all other occupants using the premises, and agree not to have any more than six people staying overnight. Proof of age may be required upon check-in. No sub-renting is permitted.
You agree to accept liability for any damages caused to the property by you or your guests, and for any items lost, accidentally taken home with you, or stolen. If damages are in excess of the security deposit being held, you agree to reimburse us for costs incurred to repair or replace damaged or missing items. Your security deposit may not cover the full extent of your liability in the event of excessive damages to the property.
2. HOMEOWNER’S ASSOCIATION RULES AND REGULATIONS: Tenant agrees to abide by the rules and regulations of the Pocono Pines Community Association and reasonable rules established and posted by the Landlord (in the binder by the front door) which deal with the Tenant’s occupancy of the property and maintenance of the property.
3. CLEANING: At the end of your lease, you agree to return the property to us in as clean and as good condition as it was at the beginning of the lease term, except for normal wear caused by reasonable use. The entire property will be inspected and cleaned after your departure. Please make sure the kitchen and bathrooms are left clean, the house is neat/orderly, the outdoor furniture is in place, outdoor items returned to the shed, and all trash/recycling has been taken out to the bins in the driveway. Complete each task on the check-out list provided.
4. NO SMOKING. Smoking is prohibited on the premises, including within the cabin, the porch, and outdoor areas of the property. Violations of this restriction are grounds for immediate removal from the premises, forfeiture of all rents and deposits and/or a charge of $300 as a special clean-up fee.
5. SLEEPING CAPACITY / DISTURBANCES: You and all other occupants will be required to vacate the premises and forfeit all monies paid for any of the following: A: Occupancy exceeding the sleeping capacity of six people. B: Using the premises for any illegal activity. C: Causing damage to the property or to any of the neighboring properties. D: Any acts which interfere with the neighbors' right to quiet enjoyment of their property (note the quiet hours in the House Guide). E: Parking anywhere other than the paved driveway area (i.e., no parking on Woodland Ave.).
6. AMENITIES: Appliances and other amenities are not guaranteed and refunds will not be given due to breakdown. Repairs will be made as soon as reasonably possible.
7. GUESTS' RESPONSIBILITY: You are responsible for locking all doors and windows upon every temporary or permanent departure. You are responsible for returning all bicycles to the shed and locking it after each use.
8. TRASH AND RECYCLING: The Tenant is solely responsible for placing all trash in the bear-resistant canister at the curb, and untagged recyclables in the exterior bins for pickup in accordance with the posted schedules. Our trash hauler has a comingled recycling program. Cardboard, plastic bottles, glass jars, aluminum, and steel cans can be placed in the same container for recycling. Placing garbage in the recycling bins attracts animals, and may result in a fine by the Township or an incidental charge to the Tenant.
9. SWIMMING, BOATS, AND WATER TOYS: You are fully aware that swimming and the usage of boats and water toys can be dangerous and deadly, and you hereby hold harmless the owner for any and all claims, demands, and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the guest, or any of his/her guests as a result of, or in connection with swimming, or the usage of boats and/or water toys made available by this property for your use. You acknowledge there is no diving or jumping off of the dock, or from watercraft. All adults and children MUST use personal floatation devices when using boats. Always store the boats upside-down on their racks when not in use.
10. PETS are not allowed on the Property at this time unless agreed upon in writing by the Landlord. (Sorry, one of us has an allergy.) In the event that a pet is discovered in violation of this rental agreement, the Tenant will be evicted with no refund.
11. ACCEPTANCE: The lease shall not be binding until the deposit is received and lease is fully executed by both the Landlord and the Tenant. This agreement is subject to the approval and written acceptance of the Landlord.
12. RENTABILITY:In the event of a Tobyhanna Township, Pennsylvania, or Federal Government ban on short-term rentals, whereas the Tenant is not legally allowed to occupy the Property during the period of time the Tenant is scheduled to be in the property, or if said leased premises is destroyed by fire, other casualty or acts of God so as to be unfit for occupancy, either prior to or during the term of the lease, the Landlord shall return an equitable prorated share of any rents that may have been paid in advance.
13. NEARBY CONSTRUCTION: Since we cannot predict or control where or when construction may take place, the Tenant agrees that the Landlord is not responsible for any problems encountered as a result of nearby construction and there will be no rebates, refunds, or discounts given for construction activities of any kind occurring near or adjacent to the property.
14. TRAVEL INSURANCE IS HIGHLY RECOMMENDED. We have had guests that needed to cancel at the last minute, after our refund policy expired. Refunds will not be given for cancellations or occupancy delays due to deaths in the family, medical emergencies, travel cancellations or delays, weather related events or evacuations, loss of job, or other events that would be considered Acts of God or that are out of the control of the Landlord. We recommend, for your protection, that you research and obtain trip insurance from a reputable insurance agent.
15. ADDITIONAL TERMS AND CONDITIONS: The Landlord does not assume any liability for loss, damage, or injury to any persons or their personal property. You agree to hold harmless the Landlord for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond the owner’s control. The Tenant, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Landlord of above said property from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the guest, or any of his/her guests as a result of, or in connection with, the occupancy of the premises and agrees to hold the Landlord free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors, or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.
By booking this rental, The guest hereby acknowledges and agrees to the terms above.
MOST IMPORTANT: Have fun, relax and enjoy yourself! And don't be freaked out by the fine print. In the years of renting our house, there have been no problems whatsoever; no guest has ever had their deposit withheld or asked to pay any compensation for any problems of any nature, nobody has drowned, sprained an ankle, been carried off by a bald eagle or has been eaten by a bear, fox, or deer.
